1. Acceptance of Terms
By accessing or using the NomadicTek platform at nomadictek.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including bench sales, recruiters, and anonymous visitors.
2. Description of Service
NomadicTek is an IT staffing and recruitment marketplace that connects IT consultants with employers and staffing agencies in the United States. The Platform allows users to:
- Upload and browse consultant resumes with AI-powered parsing (PDF, DOC, DOCX).
- Post and browse job requirements with AI-powered JD parsing.
- Upload and share hotlists (bench lists) of available consultants.
- Submit and receive job applications with real-time status tracking.
- Build and manage custom vendor email recipient lists for targeted notifications.
- Subscribe to filtered email alerts for new resumes, job postings, and hotlists.
- Search resumes and jobs using boolean queries (AND, OR, NOT operators).
- Share hotlists via WhatsApp and Telegram with pre-formatted messages.
- Follow other users, view activity feeds, and receive in-app notifications.
- Build public profiles with bio, avatar, certifications, and activity stats.
- Track email analytics including open rates and click-through rates.
- Save searches and bookmark resumes for quick access.
- Download candidate resumes with full tracking and notification to owners.
3. User Accounts
To access certain features, you must register for an account as either a Bench Sales or Recruiter. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and not share it with others.
- Notify us immediately at info@nomadictek.com if you suspect unauthorized access to your account.
- Be responsible for all activity that occurs under your account.
Recruiter accounts require a valid company email address. We reserve the right to reject or remove accounts that use personal or free email providers.
4. Acceptable Use
You agree not to use the Platform to:
- Post false, misleading, or fraudulent job requirements, resume information, or hotlist data.
- Upload resumes, hotlists, or vendor lists containing information about individuals without their knowledge or consent.
- Collect or harvest personal data of other users without their consent.
- Send unsolicited communications (spam) to other users or to vendor email recipients.
- Add email addresses to your vendor list without the recipient's consent.
- Abuse the WhatsApp or Telegram sharing feature to spam groups or contacts.
- Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
- Violate any applicable federal, state, or local laws, including employment and immigration laws.
- Post content that is discriminatory, harassing, or offensive.
- Use automated bots, scrapers, or other automated means to access the Platform.
- Misrepresent security clearance levels, certifications, or visa status.
- Manipulate email analytics by using automated tools to inflate open or click rates.
We reserve the right to remove any content and suspend or terminate any account that violates these Terms without prior notice.
5. Bench Sales Terms
- You represent that all information in your resume and profile is truthful and accurate.
- By uploading a resume, you grant NomadicTek a non-exclusive license to display your profile to registered users on the Platform and to convert it to ATS-friendly PDF format.
- By uploading a hotlist, you represent that you have the right to share the listed bench sales' information and that they are aware their details will be shared publicly.
- Free accounts are subject to daily upload limits (10 resumes/day). Limits are subject to change with notice.
- You are solely responsible for the content of your resume, hotlists, and any applications you submit.
- Security clearance and certification information you provide must be accurate. Misrepresentation may result in account termination.
6. Recruiter Terms
- You represent that all job postings are for genuine, lawful employment opportunities.
- You agree not to post job requirements that discriminate on the basis of race, color, religion, sex, national origin, age, disability, or any other characteristic protected by law.
- Free trial accounts receive 14 days of access with up to 10 job postings per day. The trial is non-renewable.
- Pro plan subscriptions are billed monthly at $4.99/month via PayPal.
- Bench sales information received via job applications must be used solely for evaluating that specific application and must be handled in compliance with applicable privacy laws.
- Resume downloads are limited for free accounts (2 per month). Limits reset monthly.
- You may accept or reject applications. Applicants are notified of status changes in real time.
7. Super Plan Terms
The Super plan ($20/month) is available to both Bench Sales and Recruiters and includes additional features:
- Custom vendor email recipient lists with up to 1,000 recipients (bulk upload supported).
- Send target controls: choose to notify Everyone, only your custom vendor list, or None when posting.
- Vendor email recipients can be set as private (visible only to you) or shared (available to other users).
- Up to 50 bench sales per hotlist upload and up to 15 hotlist posts per day.
- You are responsible for ensuring you have consent from all email addresses added to your vendor list.
- Abuse of the vendor email feature (spamming, adding non-consenting recipients) will result in immediate account termination.
8. Email Notifications
By subscribing to email alerts, you consent to receive automated email notifications from NomadicTek when new resumes, job postings, or hotlists are added that match your filter preferences (skills, visa status, work type, experience). You may unsubscribe at any time by managing your preferences on the Platform or by contacting us at info@nomadictek.com.
Email notifications are subject to daily sending limits based on your plan tier: unregistered subscribers receive up to 4 emails/day, registered free users up to 10/day, and paid plan users (Premium, Pro, Super) receive unlimited alerts.
9. AI-Powered Features
The Platform uses AI to parse resumes and job descriptions. By using these features, you acknowledge that AI-extracted data may contain errors and you are responsible for reviewing and correcting any auto-filled fields before submission. NomadicTek is not responsible for inaccuracies in AI-parsed data that you submit without review.
10. Social Features
The Platform includes social features such as following users, activity feeds, public profiles, and in-app notifications. By using these features, you acknowledge that your activity (posting jobs, uploading resumes, sharing hotlists) may be visible to your followers and on your public profile. You may manage your followers from your profile settings.
11. Payments and Billing
- Paid plans (Premium at $2/month, Pro at $4.99/month, Super at $20/month) are billed monthly through PayPal. All prices are in USD.
- Auto-Renewal: All paid subscriptions automatically renew at the end of each monthly billing cycle. You will be charged the applicable plan fee on each renewal date until you cancel.
- Cancellation: You may cancel your subscription at any time through your PayPal account or by contacting us at info@nomadictek.com. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then. No partial refunds are issued for unused time within a billing cycle.
- Refund Policy: If you believe you were charged in error or are unsatisfied with the service, contact us at info@nomadictek.com within 7 days of the charge. We will review each request on a case-by-case basis and process eligible refunds within 5–10 business days via PayPal.
- Failed Payments: If a recurring payment fails, PayPal will automatically retry up to 3 times. If all retries fail, your subscription may be suspended until payment is successfully processed.
- Pricing is subject to change with 30 days' notice to existing subscribers. Changes will not affect the current billing cycle.
- We do not store your credit card, debit card, or PayPal account details. All payment data is handled directly by PayPal. By subscribing, you also agree to PayPal's User Agreement.
12. Intellectual Property
The NomadicTek name, logo, and Platform design are the property of NomadicTek. You retain ownership of the content you submit (resumes, job postings, hotlists, profile data) but grant us a non-exclusive license to display, format (including ATS-friendly PDF conversion), and distribute it on the Platform. You may not copy, reproduce, or redistribute any part of the Platform without our written permission.
13. Disclaimers
The Platform is provided "as is" without warranties of any kind. We do not:
- Guarantee that any bench sales user will receive a job offer or that any recruiter will find a suitable candidate.
- Verify the accuracy of resumes, job postings, hotlists, security clearance claims, or certifications submitted by users.
- Guarantee the accuracy of AI-parsed data from resumes or job descriptions.
- Guarantee that email notifications will be delivered to all subscribers or vendor recipients.
- Guarantee uninterrupted or error-free operation of the Platform.
- Act as an employer, staffing agency, or party to any employment arrangement between users.
NomadicTek is a marketplace platform only. Any employment relationship is solely between the bench sales user and the recruiter/employer.
14. Limitation of Liability
To the fullest extent permitted by law, NomadicTek shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform, including but not limited to loss of earnings, loss of data, failed email deliveries, inaccurate AI parsing, or failure to secure employment or bench sales. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
15. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Your resumes, job postings, hotlists, vendor lists, and profile data will be removed. Provisions that by their nature should survive termination (including Sections 12, 13, 14) will survive.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the applicable courts.
17. Changes to Terms
We reserve the right to update these Terms at any time. We will notify users of material changes by updating the "Effective Date" at the top of this page. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
